Terms of Service
Last updated: July 29, 2026
1. Acceptance of These Terms
These Terms of Service govern your access to and use of bitskyber.com.
The website is operated by Shuva Mallick under the brand name Bit Skyber.
By accessing or using the website, you agree to these Terms. If you do not agree, please discontinue use of the website.
2. Website Purpose
Bit Skyber presents:
- web-development and software-engineering services;
- SaaS and dashboard development;
- design-to-code services;
- software templates, starter kits, dashboards, and digital products;
- product demonstrations;
- portfolio projects and case studies;
- external marketplace listings;
- professional contact information.
3. Permitted Use
You may use the website to:
- review our services and products;
- evaluate demonstrations and portfolio projects;
- submit legitimate project enquiries;
- visit authorised product or marketplace links;
- obtain general information about Bit Skyber.
You must not:
- interfere with or disrupt the website;
- attempt unauthorised access;
- submit malware, malicious code, spam, or fraudulent content;
- scrape or copy content through abusive automated methods;
- misrepresent your identity;
- infringe intellectual-property or privacy rights;
- use the website for illegal or harmful purposes;
- bypass licensing, payment, or access controls;
- copy, redistribute, resell, or commercially exploit protected products without permission.
4. Enquiries and Client Relationships
Submitting an email, form, or project enquiry does not create a binding contract or obligation to accept a project.
A client relationship begins only when the relevant parties agree in writing on matters such as:
- project scope;
- deliverables;
- price;
- payment schedule;
- timeline;
- milestones;
- revision limits;
- client responsibilities;
- intellectual-property ownership;
- confidentiality;
- support and maintenance.
A separate proposal, contract, statement of work, invoice, marketplace agreement, or written confirmation may govern a project.
If another agreement conflicts with these website Terms, the more specific project agreement normally governs that project.
5. Prices, Estimates, and Availability
Any pricing, timeline, feature list, package, or service description shown on the website is indicative unless expressly stated as binding.
Final price and availability may depend on:
- technical complexity;
- project scope;
- number of pages or features;
- integrations;
- content readiness;
- design requirements;
- licensing requirements;
- deadlines;
- revision expectations;
- maintenance or support needs.
We may change website prices, descriptions, products, or availability without prior notice.
6. Digital Products and Templates
Products displayed on Bit Skyber may include:
- website templates;
- admin dashboards;
- SaaS starter kits;
- source-code packages;
- UI systems;
- components;
- themes;
- related documentation.
Some products may be sold, licensed, downloaded, or supported through third-party marketplaces.
A product purchase does not transfer ownership of the underlying intellectual property. It grants only the rights permitted under the applicable licence.
7. Marketplace Purchases
When a product is purchased through a third-party marketplace:
- payment is processed by that marketplace;
- its licence terms apply;
- its refund and cancellation rules apply;
- its delivery and download process applies;
- its account and dispute procedures apply;
- its privacy policy applies.
Bit Skyber cannot override a marketplace’s policies or guarantee that a third-party platform will always remain available.
8. Product Licences
Unless otherwise stated, products may not be:
- resold as standalone products;
- redistributed or shared publicly;
- uploaded to file-sharing websites;
- sublicensed beyond the permitted licence;
- used to create a directly competing template product;
- represented as entirely original work created by the purchaser;
- copied into public repositories when the source code is commercially licensed.
Open-source libraries included in a product remain governed by their respective licences.
Always review the licence included with the product or supplied by the marketplace.
9. Refunds
Refunds for marketplace purchases are governed by the marketplace’s applicable refund policy.
For direct service engagements, refund, cancellation, and termination conditions will be stated in the applicable proposal, contract, invoice, or written agreement.
Unless required by law or expressly agreed otherwise, completed work, accepted milestones, downloaded digital products, customised work, and time already spent may not be refundable.
10. Support and Updates
The availability and duration of support, maintenance, documentation, and product updates depend on:
- the specific product;
- marketplace terms;
- package or licence purchased;
- separate support agreements;
- continued compatibility with third-party technologies.
We do not guarantee indefinite free updates or lifetime support unless this is expressly stated in writing.
11. Client Responsibilities
Clients are responsible for:
- providing accurate requirements;
- supplying necessary content and access;
- reviewing work on time;
- obtaining rights to materials they provide;
- ensuring submitted content is lawful;
- maintaining secure credentials;
- paying agreed invoices and milestones;
- backing up delivered materials;
- reviewing production systems before launch.
Delays caused by missing information, access, content, payment, or feedback may affect delivery schedules.
12. Intellectual Property
Unless otherwise stated, Bit Skyber or Shuva Mallick owns or licenses the original content appearing on the website, including:
- text;
- branding;
- graphics;
- layouts;
- product presentations;
- screenshots;
- demonstrations;
- documentation;
- case studies;
- original source code;
- downloadable products.
You may view website content for legitimate evaluation purposes.
You may not reproduce, republish, distribute, sell, modify, or commercially exploit protected materials without permission or an applicable licence.
13. Public Repositories and Open Source
Public GitHub repositories are governed by the licence included in the relevant repository.
A publicly accessible repository without an explicit licence does not automatically grant permission to copy, distribute, modify, or sell the code.
Third-party libraries, frameworks, icons, fonts, and assets remain subject to their respective licences.
14. Client Work and Portfolio Use
Some portfolio content may include work created for clients, agencies, employers, collaborators, or third-party marketplaces.
Rights remain subject to the applicable contract, authorisation, or licence.
Bit Skyber will not knowingly publish confidential client information without permission.
Where agreed, completed work may be shown in a portfolio, case study, or professional profile after public launch.
15. Third-Party Services
Products and services may depend on third-party technologies or providers, including:
- hosting;
- databases;
- APIs;
- payment platforms;
- cloud storage;
- authentication providers;
- open-source libraries;
- marketplaces;
- social platforms.
We are not responsible for third-party outages, policy changes, security incidents, pricing changes, API modifications, service discontinuation, or incompatibility outside our reasonable control.
16. Demonstrations
Live previews and demonstrations are provided for evaluation.
They may:
- use sample or fictional data;
- contain limited functionality;
- differ from a commercial release;
- be temporarily unavailable;
- be updated without notice;
- depend on external hosting or APIs.
Do not enter confidential or sensitive information into a public demonstration.
17. No Warranties
The website, demonstrations, and informational content are provided on an “as available” basis.
To the extent permitted by law, we do not warrant that:
- the website will always be uninterrupted;
- all demonstrations will remain active;
- all content will always be error-free or current;
- every product will satisfy every specific use case;
- third-party tools will remain compatible indefinitely;
- a service or product will produce a particular financial or business result.
18. Limitation of Liability
To the extent permitted by applicable law, Bit Skyber and Shuva Mallick will not be liable for indirect, incidental, special, or consequential losses arising from:
- use of or inability to use the website;
- reliance on website information;
- third-party websites or services;
- demonstration downtime;
- loss of data;
- unauthorised redistribution;
- business interruption;
- lost profits or opportunities;
- misuse of a product;
- changes to third-party technologies.
Nothing in these Terms excludes liability that cannot lawfully be excluded.
19. Indemnification
You agree to be responsible for claims, losses, or expenses resulting from your unlawful use of the website, violation of these Terms, misuse of a product, or infringement of third-party rights.
20. Suspension or Termination
We may restrict access to the website, products, demonstrations, or support where reasonably necessary because of:
- misuse;
- abuse;
- attempted unauthorised access;
- licence violations;
- fraud;
- non-payment;
- unlawful activity;
- security risks.
21. Privacy
Personal information is handled according to the Bit Skyber Privacy Policy.
22. Changes to These Terms
We may update these Terms when our services, products, technology, business practices, or legal requirements change.
The current version will be published with an updated date.
23. Governing Law
These Terms are governed by the applicable laws of Bangladesh, subject to any mandatory rights that apply under another relevant jurisdiction.
